Minnesota No-Fault: How No-Fault Works
All owners and drivers of motor vehicles (not motorcycles) in Minnesota are required to have Minnesota No-Fault Auto Insurance. All motor vehicle accidents in Minnesota should be covered by the Minnesota No-Fault Law. The Minnesota No-Fault Law pays Medical/Rehabilitation Expenses and Non-Medical Expenses (lost income and replacement services) caused by a motor vehicle accident up to a policy limit (usually $20,000 for each coverage) regardless of who is at fault. These out-of-pocket expenses -- often referred to as No-Fault expenses or Personal Injury Protection (PIP) expenses -- are paid by your insurance company – just like medical insurance.
General Principles
A. Paid by your own auto insurance company regardless of fault.
B. Covers specific Medical/Rehabilitation Expenses and Non-Medical Expenses.
Incurred as a result of personal injury or death.
Arising from the maintenance or use of a motor vehicle.
Minimum policy limits = $20,000 for each coverage.
If you are injured in a motor vehicle accident, you may be entitled to
No-Fault benefits including:
- Medical/Rehabilitation Expenses
Treatment expenses including chiropractic and prescription.
Mileage to and from treatment appointments.
Professional counseling, education, and retraining if disabled from work.
2. Non-Medical Expenses
Loss of Gross Income equaling 85% to maximum of $250/week.
Replacement Services to a maximum of $200/week beginning 7 days after
the accident including:
Housecleaning
Lawn mowing, and
Household services
Funeral Expenses to a maximum of $2000.
C. Does not include property damage or pain and suffering.
To make a claim for pain and suffering and other Non-economic losses, you
must meet one of the No-Fault thresholds.
No-Fault Thresholds
1. $4,000 in treatment expenses, OR
2. 60 days inability to work or perform your normal daily activities, OR
3. A permanent injury or disfigurement, OR
4. Death
D. In addition to No-Fault benefits, you may be entitled to non-economic
losses including:
1. Past pain and suffering.
2. Future medical expenses.
3. Future lost earning capacity.
4. Future pain and suffering.
