Description:  Plaintiff’s vehicle was struck broadside when defendant failed to stop for a red light.  Plaintiff was a factory laborer with no visible sign of injury.  Before the collision, plaintiff worked 12-hour shifts.  Following the collision, plaintiff was unable to work more than 4 hours per shift and was assigned to light duty work.

Injury:  33-year-old plaintiff sustained a traumatic brain injury and had on-going and permanent residuals as a result, including cognitive impairment, headaches, fatigue, and short term memory loss which required significant medication.

Outcome:  Settlement of $1,027,500 including all No-Fault limits.

Structured settlement included periodic payments including college funding for plaintiff’s four minor children.

Description:  A train struck plaintiff’s vehicle at a railroad crossing.

Injury:  40-year-old plaintiff suffered catastrophic injuries including a severe traumatic brain injury leaving him permanently and totally disabled.  Plaintiff is unable to return to competitive employment for the rest of his life.

Outcome:  Settlement one week before trial for $1,140,000.

Description:  In the early morning hours, while he was assisting in the delivery of equipment by a semi tractor trailer, another vehicle struck plaintiff.

Injury:  37-year-old plaintiff suffered catastrophic injuries including a severe traumatic brain injury leaving him permanently and totally disabled.  Plaintiff is unable to return to competitive employment for the rest of his life.

Outcome:  Settlement for the total insurance policy limits of $400,000 including all Liability and UIM limits.  In addition, settlement of $600,000 for claim against owner of semi tractor trailer, which was not involved in the impact.

Description:  Claimant was a Civil Engineer.  He was injured while lifting manhole covers and catch basin covers which weighed 75 to 200 pounds each on a hot July day.  Claimant was a professional whose job required significant multi-tasking.  Claimant’s office was in Nebraska, but he was working in Iowa when injured.

Injury:  30-year-old single claimant suffered catastrophic injuries including a severe traumatic brain injury leaving him permanently and totally disabled.  Claimant was in a comatose condition for 107 days and was hospitalized for more than six months.  Claimant’s functional limitations include quadriparesis, cognitive deficits, and limited work stamina.  Plaintiff is unable to return to competitive employment for the rest of his life.

Outcome:  Award by the Industrial Commission included lifetime permanent total disability benefits, subrogation reimbursement for all medical expenses and long term disability payments paid before the award, and nursing services performed by his mother after he left the hospital—all in a total amount of $750,000.  Lifetime benefits are continuing and have included medical, rehabilitation, and retraining benefits, payment for numerous experimental treatments and surgeries, and payment for residential services in hospitals, group homes, Courage Center, and other residential treatment centers.  Total payout to date is nearly $3 million.

Note:   Claimant’s acute subdural hematoma was caused by the bursting of two veins in his brain.  It is unusual that a traumatic brain injury caused by exertion would affect veins—rather than arteries—in the brain.

Description:  45-year-old plaintiff was a passenger on a motorcycle involved in a collision which resulted in minor property damage.  The plaintiff passenger was ejected from the motorcycle and sustained a massive head injury resulting in her death.  Neither the plaintiff passenger nor the driver was wearing a helmet.  Plaintiff was a mother with two minor children.

Outcome:  Confidential settlement equivalent to the total insurance policy limits including all No-Fault and Liability limits.

Structured settlement included periodic payment including college funding for plaintiff’s two children.

Location:  Fillmore County, Minnesota.

Description:  Plaintiffs were passengers in a yellow school bus that crossed the Interstate 35 bridge in Minneapolis when the bridge collapsed.

Injuries:  Plaintiffs sustained soft tissue spinal injuries and Post Traumatic Stress Disorder.

Outcome:  Kauffman Law Firm was a member of the Consortium of lawyers representing the I-35 victims negotiating settlements for each of the plaintiffs.

Description:  Plaintiffs from Minnesota were injured in Wisconsin when another vehicle crossed the center line and crashed into their vehicle. 

Injury:  54-year-old plaintiff suffered fractures of the low back, multiple ribs, and jaw.   

Outcome:  Settlement for $315,720 including No-Fault medical expenses and wage loss. 

Injury:  55-year-old plaintiff suffered soft tissue cervical injuries and lacerations.

Outcome:  Settlement for $36,500 including No-Fault medical expenses and wage loss.

Description:  Plaintiff was injured when the car in which she was a passenger rolled over.  Plaintiff was unable to return to her regular employment for nine months because of the sensitivity of the degloving injury and scar.

Injury:  62-year-old plaintiff suffered a C7 T1 anterior fusion with wiring and a degloving injury resulting in extensive skin grafting of her right hand and arm leaving a scar.

Outcome:  Settlement for the total insurance policy limits of $300,000 including Liability and UIM limits.  In addition, No-Fault benefits of $20,000 in medical expenses and $13,300 in wage loss were paid.

Description:  Plaintiff was a passenger in a vehicle driven by his spouse when the spouse lost control and the vehicle overturned ejecting plaintiff.

Injury:  44-year-old plaintiff suffered catastrophic injuries including a severe traumatic brain injury leaving him permanently and totally disabled.  Plaintiff is unable to return to competitive employment for the rest of his life.

Outcome:  Settlement for the total insurance policy limits of $290,000 including all No-Fault and Liability limits.  Plaintiff’s claim for UIM coverage under the family’s Personal Umbrella Policy (PUP) was rejected by the Minnesota Court of Appeals because of a household exclusion.  Plaintiff has a Supplemental Needs Trust.

Description:  Plaintiff was injured when struck by a motor vehicle owned and operated by a commercial business.  Plaintiff was crossing a major intersection in the crosswalk with a green light.  Plaintiff had pre-existing cognitive impairment.

Injury:  73-year-old plaintiff sustained a traumatic brain injury and had on-going and permanent residuals as a result, including cognitive impairment, diminished mental capacity, changes in personality, fatigue, and short term memory loss.  Plaintiff was identified by Olmsted County Social Services as a “Vulnerable Adult” as a result of the symptoms sustained.

Outcome:  Settlement for $240,000.

Description:  Plaintiff was injured when a Mayo Clinic doctor ran a red light and crashed into the passenger door of plaintiff’s motor vehicle.

Injury:  26-year-old plaintiff sustained thoracic outlet syndrome, annular tear and disk protrusion of the low back, and major depressive disorder with anxiety and sleep disturbance.

Outcome:  Settlement for $120,000 including No-Fault benefits of $40,000 in medical expenses and $7,500 in wage loss.

Description:  Plaintiff was injured when his motor scooter was struck by a motor vehicle that failed to stop at a stop sign. 

Injury:  32-year-old plaintiff suffered a right wrist fracture which required bone grafting and screw fixation.  In addition, plaintiff suffered a right ankle fracture with closed reduction surgery.

Outcome:  Settlement for the total insurance policy limits of $105,000 including all Liability and Medical Pay limits.  Plaintiff did not have UIM coverage on the motor scooter.

Description:  Plaintiff was injured when struck by a motor vehicle owned and operated by a commercial business.  Plaintiff was crossing a major intersection in the crosswalk with a green light.

Injury:  74-year-old plaintiff sustained a fractured right leg, which required a full cast and full leg removable brace with crutches for several months. Plaintiff had a good recovery.

Outcome:  Settlement for the total of $112,100 including No-Fault benefits of $8,200 in medical expenses and $3,900 in replacement services expenses.

Description:  Plaintiff was injured when her motorcycle was struck by a motor vehicle that failed to stop for a stop sign.

Injury:  48-year-old plaintiff suffered a fracture of the radius and ulna below the wrist, resulting in surgery to wire, plate, and pin the fragments of the shattered radius.

Outcome:  Settlement for the total Liability insurance policy limits of $100,000.  Plaintiff did not have UIM coverage on the motorcycle.

Description:  A grade school student who attended a class outing at a ski area collided with a tree during learn-to-ski instruction supervised and instructed by employees of the ski area.

Injury:  10-year-old plaintiff fractured both of her wrists.  Within 48 hours, these injuries resulted in a severe staph infection which nearly caused plaintiff’s death.  Plaintiff was in a comatose condition for 17 days on an oscillator to maintain breathing.  Injuries included below-the-elbow amputation of the right forearm, significant loss of muscle mass resulting in surgical disfigurement of the left arm, and development of Adult Respiratory Distress Syndrome (ARDS).

Outcome:  Confidential settlement equivalent to the total insurance policy limits.

Structured settlement included periodic payments including college funding for plaintiff.

Description:  Plaintiff was injured in the course of unloading flat metal from a semi tractor trailer when a load of flat metal slid off the forks of a forklift and came down on plaintiff crushing his leg.

Injury:  Plaintiff suffered a shattered left femur which required surgical repair by inserting a rod and screws.

Outcome:  Settlement for $271,000.

Location:   Dane County, Wisconsin.

Description: A pit bull running loose attacked plaintiff.  Plaintiff was thrown to the ground several times.

Injury:  68-year-old plaintiff broke her collar bone and two ribs.  Plaintiff had an excellent recovery.

Outcome:  Settlement for $46,000.

Description:  Plaintiff’s bicycle collided with a bicycle operated by a 6-year-old child on the Rochester Bikeway Trails.  The child was riding with his parents when he crossed the center line of the bike trail causing the collision.

Injury:  84-year-old plaintiff suffered a left hip fracture, left elbow fracture, and left shoulder fracture.

Outcome:  Settlement for $130,000 including payment of medical expenses.  Plaintiff had cancer which prevented participation in the legal process including an Independent Medical Examination.

Description:  33-year-old claimant was involved in a motor vehicle accident.  The No-Fault insurer had paid $30,000 in No-Fault benefits.  A No-Fault arbitration claim was made for unpaid medical expenses of $10,300.

Outcome:  At hearing, the No-Fault insurer agreed to pay stacked policy limits of $60,000 in medical expenses and $60,000 in wage loss.

Note:  Earlier in the case, the No-Fault insurer had cut off wage loss payments causing significant financial problems for plaintiff.  Kauffman Law Firm brought a temporary restraining order.  The judge reinstated No-Fault wage loss benefits and awarded attorney’s fees for cutting off No-Fault wage loss benefits without cause.

Description:  45-year-old plaintiff was involved in two separate motor vehicle accidents.  Plaintiff claimed psychological injury including driving phobia—fear and anxiety while driving—resulting from physical injuries.  The No-Fault insurer argued that the No-Fault Law does not provide coverage for psychological injuries.

Outcome: The No-Fault Arbitrator awarded and the District Court affirmed medical expenses and wage loss benefits for psychological injuries resulting from physical injuries.
